Please read these Terms of Use carefully. They constitute an agreement between you and BRILANI and govern your use of, and any purchase from brilani.com (the “Site”). BRILANI, in its sole discretion, reserves the right to change or modify any of the following terms and conditions, or any other policy or guideline of the Site at any time. Any change or modification will be effective immediately. By using the Site, you agree to be bound by these terms and constitute your acceptance of changes or modifications. If you do not agree with the terms, you must cease using the Site.

While we make every effort to ensure items and prices are displayed as accurately as possible, errors may occur. We reserve the right to correct any and all errors if they do occur and will not honor inaccurate or erroneous prices. We will not be held responsible for errors and omissions on the site.

Pricing and Product Information
If a product’s listed price on brilani.com is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has already been shipped, you agree to pay the difference between the actual and charged price or return the product. We apologize for any inconvenience this may cause.

All prices on brilani.com are subject to change without notice. Material on the site may also contain technical inaccuracies or typographical errors (Including pricing errors), and may be changed, updated or modified at any time and without notice.

We will not be held liable or responsible for any such inaccuracies, errors, changes or updates. We reserve the right in our sole discretion to add, delete or change some or all products and services at any time.

BRILANI makes every attempt to accurately depict the products offered on the Site, however, because the depiction of a product depends (at least) partly on the specifications of your computer and monitor, we cannot guarantee that such depiction will be accurate. The products may also appear larger or smaller than their actual size depending on your monitor and resolution. Images on the Site can be enlarged to show product detail.

Discounts and coupons cannot be used in conjunction with other offers on the Site. Only one discount code or online offer can be used per order. We reserve the right to cancel any order, or withdraw/extend any promotion on the Site at our discretion.

Disclaimer
BRILANI reserves the right to refuse or cancel orders at any time, including orders containing incorrect pricing and/ or incorrect product descriptions, or when BRILANI believes a customer is abusing the Site’s return policy. This includes, but is not limited to, ordering multiple products and returning them. BRILANI reserves the right to refuse an order from a customer for any reason at any time.

Limitation on liability
At no time shall BRILANI or its representatives be liable for any damages, direct or indirect, including but not limited to loss of data, loss of profits, whether in an action in tort, contract, including but not limited to negligence, arising out of or in any way connected to the use of brilani.com, the products, services, or content on the Site, including but not limited to any damages resulting from reliance by any user on information obtained from BRILANI, or damages resulting from omissions, mistakes, deletion, interruptions or email errors, viruses, delays in operations or transmissions, defects or any performance failure, whether or not any of these are the result of acts of God, communication failures, destruction of unauthorized access, or the theft of BRILANI’ programs or services.

Severability
If any provision of these Terms of Use shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

 

Mobile Terms of Service

The Brilani mobile message service (the "Service") is operated by Brilani (“Brilani”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Brilani’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Brilani through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Brilani. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18885476620 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Brilani mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
